OAKLAND -- A suspected gang member has been charged with fatally shooting a father of four last year in East Oakland and wounding three of his relatives during a failed robbery, police said Tuesday.
Emilio Bibiano, 19, is awaiting extradition from Las Vegas where he was arrested June 3. He is charged with one count of murder and three counts of attempted murder for a shooting that happened June 16, 2012 in the 1600 block of 28th Avenue.
Bibiano has refused to talk to police about the shootings, lead investigator Officer Leo Sanchez said Tuesday.
Killed in the shooting was Augusto Matias, 34, the father of four daughters ages 2 to 11, who live with their mother, his widow, in his native Guatemala.
Wounded in the shooting were Matias' 40-year-old brother, and two cousins, ages 36 and 31. The three have since been released from hospitals. The older cousin, who suffered severe internal injuries, including the loss of a kidney, faces a lengthy recovery and possibly won't ever be able to work again, police said.
Police said the four victims, all from Guatemala, were laborers who mostly did construction work. Matias had been regularly sending money to his family in Guatemala and hoped at one point to bring them to Oakland.
Sanchez said the four men were outside the home Matias shared with his brother about 3:30 a.m. last June 16 continuing a celebration that began with a relative's graduation party the night before.
Bibiano used to live on the same street and when he saw the men decided to rob them, Sanchez said. "He thought they would be easy targets who would not resist him," Sanchez said.
But one of the men apparently did resist, prompting the shooting, police said. Nothing was taken from any of the men.
Police said soon after the shooting Bibiano moved to Las Vegas with other family members.
Sanchez said "great work" by Officer Jorge Pereda, who found some independent witnesses, led to Bibiano being identified as the gunman. Pereda also developed information where Bibiano had moved to.
Bibiano was arrested on a probable cause warrant June 3 by U.S. Marshals at a Las Vegas beauty supply company warehouse where he worked. He is being held without bail in Las Vegas. It is not known when he will be extradited to Oakland.
