OAKLAND -- A 23-year-old Oakland man accused of shooting at an auto repossessor towing a car with a woman inside the trunk pleaded not guilty to felony charges on Thursday.

Oakland police say the woman had either fell in or jumped in the trunk of her BMW as it was in the process of being towed in the 900 block of Seventh Street in West Oakland on July 25.

The tow truck driver told police that he didn't hear the woman's cries from inside the trunk before Gabriel Duncan allegedly fired several shots at the tow truck. No one was injured.

Police said they did not know Duncan's relationship to the woman.

The incident in the 900 block of Seventh Street began at 9:17 a.m. July 25, when the repossession agent prepared to tow a BMW belonging to a woman Duncan knows, police said.

Duncan was charged with assault with a firearm, felon in possession of a firearm, shooting at an occupied vehicle, and violating his probation. He is being held in Santa Rita Jail in lieu of $430,000 bail.

His preliminary hearing is scheduled for Sept. 25.
