Tommy Driver II, 32, was found guilty in August of possessing cocaine base for sale, according to information from the San Bernardino County District Attorney's office. The jury panel also found the allegation that the offense was committed for the benefit of a criminal street gang with the specific intent to assist in criminal conduct by gang members was true.
In April San Bernardino police officers watched as Driver, a member of the Projects criminal street gang, put a cup on the ground and walked away, officials said.
When they examined the cup, officers found 10 bags of what appeared to be cocaine.
As they arrested Driver, he made several verbal references to his gang affiliation, officials said.
During trial at the San Bernardino Superior Court, officers testified that on at least four other occasions, Driver made the same gang references. Driver testified that he was only holding the baggies for a fellow gang member.
