SAN JOSE -- Police announced Thursday that felony charges with gang enhancements have been filed against six men and one woman following a house party last week that ended with 42 arrests after a long standoff and allegations of bottles being hurled at officers.

Charges were filed against Adam Joe Mendivil, 18, Gary Frank Mendivil, 22, Rhonda Renea Fimowicz, 44, Brian Anthony Fosselman, 22, Adrian Gradillas, 29, Manuel Victor Flores, 29, and Alexander Mitchell Gonzales, 20. All are San Jose residents.

The seven defendants all face counts of resisting arrest. Fosselman, Gradillas, Gary Mendivil and Flores have also been charged with assault with a deadly weapon on a police officer, and Gonzales with a probation violation. Gang enhancements were added for each defendant.

On Nov. 23, officers were called to a home in the 3000 block of Patt Avenue in East San Jose shortly before 11 p.m. on reports of gunfire, and found people jumping fences and acting hostile to arriving police.

One officer was struck with a thrown object, and police said a partygoer then attempted to drag him to the rear of the residence but the officer broke free.

After several hours, 70 San Jose police officers, with assistance from Santa Clara County sheriff's deputies, quelled the party and made the arrests.

Some partygoers have since accused police of overreacting and using excessive force when they arrived, triggering an angry response from the crowd.
