Halle Berry's ex Gabriel Aubry got a temporary restraining order against Halle Berry's fiance Olivier Martinez on Monday, claiming Martinez threatened to kill him before beating him up on Thanksgiving.
And judging by post-brawl pictures Aubry released on Monday, it looks like it wasn't just a threat. So much for the stereotype of the French running from fights. At least one of them seems pretty good at it.
Aubry got the order late Monday, after Berry got her own temporary order against Aubry. Aubry alleges that Martinez threatened to kill him if Aubry didn't let Berry and Martinez move to France with her and Aubry's 4-year-old daughter, Nahla, according to E! News.
Duringan ugly custody battle, a judge earlier this month ruled that Berry can't move her daughter to France. Which apparently didn't please Martinez.
In a court filing obtained by E! News, Aubry alleges Martinez first confronted him last Wednesday outside Nahla's school, saying in French, "I wish I could beat the (expletive) out of you right now. We're going to take Nahla right now and you're not going to follow us." Nahla ended up leaving school with Aubry, as scheduled.
He yelled at him at French? No wonder Aubry thought he could take him.
The next day, Thanksgiving, Aubry alleges he dropped off Nahla at Berry's house when Martinez attacked him. The court filing says, "He continued to punch me at least two or three times, kicked
I wouldn't go to Paris either if everyone there acts like this Martinez guy.
Aubry also alleges Martinez threatened to kill him if he didn't claim that he attacked Martinez. Aubry supposedly told police Martinez attacked him, but he was handcuffed, put in an ambulance and taken to Cedars-Sinai Medical Center. He was arrested on suspicion of attempted battery.
Aubry's restraining order says Martinez must stay at least 100 yards away from Aubry. Maybe they should have made it farther. A hearing is scheduled for Dec. 17 over whether the temporary order becomes permanent.
Meanwhile, attorneys for both Aubry and Berry were in court Tuesday, arguing over Berry's temporary restraining order against Aubry.
Neither Halle nor Gabriel was in the courtroom, and there's no word on what was said at the hearing, which was closed off to media. Berry's attorney has said they want to make the order -- which specifies that Aubry must stay away from his daughter -- permanent.
