SAN JOSE -- A man in his 30s died from a gunshot wound early Sunday, and another man is in custody as police investigated the city's 40th homicide of the year.

According to Sgt. Heather Randol, police received an emergency call at 4:26 a.m. that someone had been shot in the 900 block of West San Fernando Street in the St. Leo's neighborhood just south of downtown. Family members drove the victim to an area hospital as officers were responding, Randol said in a news release.

The victim had at least one gunshot wound and died at 4:54 a.m. at the hospital, said the police spokeswoman, who added that the suspect and victim knew each other.

Police arrested the suspect soon after arriving at the scene, which homicide investigators had roped off well into Sunday afternoon.

The victim's identity was not released, pending notification of his next of kin. Police did not release the identity of the suspect.
