The claims of 10 of the 130 total plaintiffs -- former lab scientists and engineers alleging Lawrence Livermore National Security unfairly targeted senior employees for dismissal -- will be tried in Alameda County Superior Court on Jan. 26.
The plaintiffs are suing for wrongful termination, breach of contract, age discrimination, and other claims.
In Phase 1 of the trial, in May 2013, a jury found lab operators -- a partnership headed by the University of California and Bechtel Corp. -- breached contracts with five of the plaintiffs, awarding them $2.7 million in damages. During the trial's second phase, in December, a separate jury ruled in favor of the lab on the age discrimination claims, finding the layoffs did not disproportionately affect employees 40 and older.
