Man to stand trial in alleged road rage
A Capitola man will face charges in an alleged road rage incident where he is accused of firing a flare gun into a moving car. The incident set the car on fire.
Dante Stewart, 63, was arrested June 20. Stewart allegedly fired a flare gun into a car full of people on Capitola Road, near Woodrose Avenue, Santa Cruz County sheriff's deputy Ryan Kennedy said at the time.
During a preliminary hearing Monday, Santa Cruz County Superior Court Judge Stephen Siegel found sufficient evidence to move forward with a trial. During the hearing, sheriff's deputy Erik Miyoshi testified that Stewart admitted to firing the flare gun into the air.
The flare gun missed hitting the car's four occupants, but lit up a hat sitting on the car's center console.
Stewart is scheduled to be arraigned Aug. 11 on charges of shooting into an occupied vehicle and assault with a deadly weapon, both felonies, and recklessly causing fire to another person's property, a misdemeanor.
